Deceased Estate Sales with Dawsons Property

Deceased Estate Sales

It can prove a stressful and distressing time when you are responsible for arranging the deceased estate of a loved one.  It is important for us to provide you with a realistic market price (upon which any inheritance tax liability will be calculated) and this probate valuation will be carried out with a sympathetic and caring approach.

If selling through private treaty you must wait for probate to be granted. Once granted, we will be able to place your property onto the market for sale.  If the property is to be sold by auction we can actually sell before the grant of probate, another reason why we sell so many deceased estates sell in this way. If probate is still not granted by the 28 day completion period, there is a clause in the contract stating that completion will happen 7 days after the grant of probate.

So we feel that selling by Auction is perfect for deceased estate sales for the following reasons:

  • Demand is very high for properties requiring refurbishment or renovations.  Often a deceased sale property has been lived in by an elderly relative and may not have been updated to modern standards.
  • Low priced properties often achieve much higher figures than they would on the open sales market, due to the excitement of the bidding process and the expertise of the auctioneer.
  • Auction sales exchange on the day and complete within 28 days.  On top of the stress of losing a loved one, there is no worry about sales falling through, chains collapsing or surveys being under-valued.

Dawsons are the only Swansea agent with an in-house Auction Team and we run auctions at the Swansea Marriott Hotel every 2nd month.  In 2019 we have run 4 auctions with 60 lots sold totalling £1,274,000. At our August Auction 21/21 properties sold, a number of which were deceased estate sales.

Timeline:

1. Grant of probate (2-3 months)

Required to enable executors to sell or transfer the property. The grant is a form of certificate issued by the court that confirms the validity of the will and gives the executors authority to deal with the deceased’s estate.

2. Probate valuations (2 weeks)

The executors should obtain two or three estate agents’ valuations and take the average as the value of the property, or obtain a surveyor’s valuation.

3. Title and deeds (1 hour to weeks if not registered)

The executors should also check the title to the property. If the property is registered with the Land Registry, this is a straightforward matter of downloading a copy of the title entries and plan from the Land Registry website, checking that the property is in the deceased’s name and that the plan shows the full extent of the property.

If the property is not registered, the executors will need to locate the paper title deeds, which hopefully are held safely by the deceased’s solicitor or their bank.

Preparing the Legal Documents (4 weeks*) Once the title and deeds are located, the executors should ask a solicitor to check them for any restrictions affecting the property, or defects in the title, which will need to be dealt with before the property can be sold. If the property is going to the Auction House, a legal pack will need to be prepared prior to listing the property.  One issue which often arises is when the property was not transferred to the deceased on the death of a spouse so this will add time to the process.

4. Marketing for Auction (Dawsons 6-8 weeks )

5. Marketing for Sale on the Open Market (National average 6-8 weeks)

Other Considerations:

Property Clearance

The deceased’s property will need to be cleared of all its contents before the property is sold and this is often a sticking point for the executors or family.

Capital Gains Tax

For the year of death and the following two years, the executors have a CGT allowance of £12,000 (for 2019-20).  Executors should take legal advice on the title to the property and the taxation aspects of selling before placing the property on the market.

“Tag your Tots” was the theme, and positioned at the entrance, the staff were on hand to get all of the children wristbands with their parent’s emergency contact details secured on their arms, so that, heaven forbid, they wandered off during the excitement,  their parents or guardians could easily be contacted and traced….. especially with all eyes raised up to the sky for the aerobatic entertainment.

On top of this, there was lots of face painting, aeroplane stencils and glitter at the ready, plus selfie frames for photos and lots of advice about the events happening over the 2 days.

We took so much pride in being a part of the anniversary celebrations for Swansea City’s 50th birthday.

Whether you’re over the moon or underwhelmed, Boris Johnson is now Prime Minister of the UK.

boris johnsonHe’s got form in the housing sector including his relatively unsuccessful attempt to introduce a minimum ‘rental standard’ in London when he was mayor, but now takes charge of a government that has several flagship housing market measures underway.

Will Bojo keep his housing team as it is? Will he alter James Brokenshire’s plans to reform Section 21 evictions, reform leasehold ownership, regulate estate agency and set up a publicly-available database of rogue landlords and agents? And will he follow through on his promise to reform Stamp duty? It will be an interesting few weeks. Effectively we here in Swansea have Rent Smart Wales (RSW) which already has in place a number of the suggested processes – in simply terms policing the PRS and looking at continued ways to improve standards across the board without the unexpected and detrimental financial consequences.

21 Brookville Road was brought to the market in March 2019 in readiness for our last auction on April 17th.

The vendors chose auction as they wanted a quick sale, it was a rental property for themselves and the property had deteriorated over the last couple of years.  Instead of spending a lot of money on a revamp of the house, they made the decision to sell it in a pretty run-down condition.

We began marketing the property and within 3-weeks we received an offer, at first the offer wasn’t quite what the vendors were looking for, however, thanks to our awesome auction negotiators a deal was agreed and both purchaser and vendor were really happy.

Even though the vendors accepted a pre-auction offer, it remained under auction conditions of an immediate exchange and completion to happen in 28 days. The property completed on the 18th of April a day after it was meant to go to the auction room, the whole process took 8 weeks from start to finish.

Top tips on what to do before bidding at Auction

It is so important to do your due diligence before you take the plunge and bid at an auction, so here are some top tips from our Auction Company EIG:

When considering purchasing a particular property at auction it is essential that you prepare by doing your due diligence research in advance. It is your responsibility to be completely satisfied with the property before the auction so you can make an educated decision whether to bid for the property or not and what your maximum bid would be.

Doing your due diligence includes:

  • Viewing the property
  • Ascertaining the likely sale price
  • Reading the legal pack

Then, if it is a property you wish to pursue it is prudent to:

  • Instruct a property survey
  • Ask your solicitor to review the legal pack
  • Viewing a property

It is important to view every property you are interested in prior to the auction.  Contact the auctioneer to arrange the viewing which may be arranged as fixed time slots for group viewings (open house viewings) or individually arranged.

It may be useful at this point to bring an experienced builder or knowledgeable friend with you to the property who can spot any potential problems that would need to be included in your financial calculations or may mean the property is no longer of interest to you.

When looking at buying any property it is advisable to view it at least twice, during the daytime and at night which may be just a ‘drive by’ viewing.  The plans and photographs published in the catalogue are there to aid identification of the property only, the plans may not be to scale so you need to verify them.

What to take to a property viewing:

  • Camera
  • Tape measure (preferably a laser as much quicker especially if viewing is busy)
  • Notepad or iPad
  • Torch
  • Binoculars (to check roof, gutter and chimney)
  • Portable ladder (to access loft space)
  • Suitable footwear (you may need to climb!)
  • Contact details of the auctioneer and research notes for further investigation in the area e.g. an unidentified building(Important #: Don’t forget to follow up and ask questions that arise from the viewing)

Points to evaluate:

  • Leasehold or freehold property, any additional ground rent or service charges?
  • Parking, garden, access and property boundaries?
  • Neighbours, traffic and noise?
  • Nearest shops and public transport?
  • Heating, insulation, plumbing, electrics?
  • Council tax band, energy efficiency rating?
  • Any structural issues or recent extensions?
  • Vacant or tenanted and history of the property?

Viewing in an unfamiliar area?

If an area is new to you, speak to the auctioneer and ask as many questions as you can.  It is also advisable to look online at crime sites, google the address and street, using some of the best online platforms, for example:

  • www.checkmystreet.co.uk – average rentals
  • www.streetcheck.co.uk – nearest schools
  • www.checkmyarea.com – area profile
  • www.police.uk – crime rate
  • www.rightmove.co.uk – for rental and sales prices
  • www.gov.uk/find-government-property – find government owned property
  • www.gov.uk/private-renting – private renting

Community News: Rugby & Rafts

Our Llanelli and Mumbles branches along with our marketing team have been busy during August with sponsoring two prestigious local events: the 2nd annual Burry Port Raft Race and the 30th annual Crackers 7’s rugby tournament.  

Earlier in the month our Llanelli office took to the water in the raft race while the marketing team manned the guess the balloons car, and even though the event had to be postponed from the Saturday to the Sunday due to poor weather conditions, there was a fantastic turn out for the day with all proceeds raised going to the RNLI and Afia Banjul Football Academy.

Crackers 7's Dawsons SponsorshipFurther into the month our staff and customers enjoyed a Bank Holiday Sunday full of rugby, family entertainment, a new bar and an evening of music.  For some years now Dawsons have sponsored the Crackers 7’s, bank holiday event in Underhill Park, hosting a hospitality tent, Hog Roast and some great company with a pitchside view of the day.  The sun has shone for many years, but this year the rain certainly didn’t dampen the spirits.

Industry News: Want a better mortgage deal?  

As many of us will now know on August 2nd the Bank of England raised the base rate from 0.5% to 0.75% – only the second rise in over a decade

What does this mean in real terms to those of us who currently have a mortgage and those looking to get on the property ladder and take out their first mortgage?

For current homeowners with a mortgage now is the time to check the status of your current mortgage, if you are linked to base rate you can look to re-mortgage to a fixed deal.

If you are a first-time buyer you will now benefit from some great deals on offer, our in-house mortgage advisors can offer deals fixed for 2 or 5 years with rates starting from 1.89% on a 90% LTV and 3.17% on a 95% LTV.

Dawsons expanding staffing levels in readiness for 2018

While many businesses wind down at the end of the year, Dawsons have been increasing their staffing levels in readiness for another busy New Year.  With more than 13 sales and lettings branches throughout Swansea and Llanelli, Dawsons were looking to recruit staff for several new roles within the company which will bring their staffing levels to more than 120.

Dawsons are a locally-owned business, established in 1991 with many years’ experience in the field of Residential and Commercial Property Sales and Rentals, together with their highly successful Auction Department,  Land and New Homes, Survey, Financial Services and Fine and Country Departments.  2017 proved to be another very successful, busy year with the acquisition of a smaller local letting agent and to top it off winning the Relocation Agent,  Best Agent Regional Winner 2017.

The new staff (pictured above) were all employed in the last quarter of the year and are spread throughout the company covering several different roles from Administrators, Sales and Lettings Negotiators, Inspectors to Mortgage Advisers,. They bring  with them a diverse wealth of knowledge and experience within their field.

Here’s a sneak preview of one of Dawsons’ lots ahead of our next auction at the Marriott Hotel on Wednesday, October 4 at 3pm.

The video is of an impressive lot: Shorelands situated in Penmaen, Gower with a guide price of £450,000. The property, which is a three-bedroom detached, benefits from stunning views across from Three Cliffs Bay to Oxwich Bay.

Dawsons believe the true market value of the property is between £600,000 to £650,000.

Going, going… all gone – Dawsons enjoy 100 per cent success at auction

To buy or sell at an auction is proving a popular choice among Swansea property owners as was proved at Dawsons Property’s latest event.

To mark the half year position with a bang, Dawsons’ recent auction was a complete sell out, with 100 per cent of the available stock being purchased, which included a Grade Two listed church and a large run down Manor House in Mayals.

A modern auction is great for people looking for unusual properties and they have become increasingly popular with buyers who want to avoid the traditional house buying chain.

One of the main lots at the auction was St Paul’s Church in Plasmarl.

Dawsons Sales Negotiator Corey Ashford said: “St Paul’s Church was quite an unusual and quirky lot – not a lot of Grade II churches come up in the area.  We set the guide price at £75,000 and were absolutely thrilled to see if reach £90,000 on the day”

The former St Paul’s church in Plasmarl, Swansea goes under the hammer at Dawsons Property Auction on Wednesday June 14 at 15:00 in Swansea Marriott Hotel.

The Grade II listed building is expected to ignite a lot of interest as it is such an unusual property.

Dawsons Sales Negotiator Corey Ashford said: “It’s quite an unusual and quirky lot – not a lot of churches come up in the area. There’s a guide price of around £75,000 on this so it’s a good price bracket for a lot of potential buyers.

“The church probably dates back to the end of the 19th to early 20th century, and retains quite a lot of original materials including the organ, stone walls, suspended wooden flooring and the original roof.

“It has D1 planning permission which would allow a number of uses such as a day nursery, education or training centre or medical centre. Its grade II listing means it is of historical importance, so there are restrictions as to what you can do with the building externally and internally.

“Overall it’s a great lot with plenty of potential, and it will be interesting to see who buys it and what it becomes.”

The church is one of a huge range of properties being auctioned on June 14.
